Overview

Artist or entertainer in the U.S. under a reciprocal exchange program between U.S. and foreign organizations.

The P-2 is a US nonimmigrant visa for artists and entertainers in formal reciprocal exchange programs between a US organization and a foreign counterpart. It does not require extraordinary ability — the foreign performer's skills need only be comparable to those of the US artists in the reciprocal part of the program.

Stay is up to 1 year, renewable in 1-year increments. Dependents travel on P-4 status; spouses may not work independently. Work auth is limited to the petitioning employer and approved exchange engagements. The US sponsor files the petition; a US labor organization must have negotiated or concurred with the exchange.

This visa is ideal for performers — musicians, dancers, and theater artists — already embedded in a union-sponsored reciprocal exchange with a US organization.

Advantages & Considerations

Key Benefits

  • No annual numerical cap — petitions accepted year-round
  • Explicit dual-intent protection: pending/approved immigrant petition cannot be used to deny P-2 status
  • Renewable in 1-year increments with no statutory maximum total duration
  • Premium processing available for 15-day adjudication
  • Essential support personnel may be included under a separate P-2 petition
  • Nonprofit and small-employer fee reductions available

Worth Knowing

  • Petition must be filed by the US employer/sponsor — artists cannot self-petition
  • Requires a pre-existing formal reciprocal exchange agreement between US and foreign organizations
  • US labor organization concurrence or involvement is mandatory
  • Authorized only for the specific employer and events described in the approved petition
  • Standard processing can run 3–6 months; plan well ahead of performance dates
  • Dual-intent protection does NOT extend to essential support personnel (P-2S holders)
  • Standard INA inadmissibility grounds apply, including crimes involving moral turpitude

Application Process

1

US employer or sponsoring labor organization files Form I-129 (with P Supplement) with USCIS

2

Optionally file Form I-907 for premium processing (15-day adjudication)

3

USCIS approves petition and issues Form I-797 approval notice

4

Applicant completes Form DS-160 (Online Nonimmigrant Visa Application) at the State Dept. CEAC portal

5

Pay $205 MRV fee and schedule consular interview at nearest US embassy or consulate

6

Attend visa interview (required for most applicants aged 14–79)

7

Consulate issues P-2 visa stamp; enter the US and receive CBP admission for the approved period
