1. Acceptance of Terms
By accessing and using BorderProof — including creating an account, using our eligibility checker, uploading a CV, or browsing our content — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
2. Eligibility to Use
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use BorderProof. By using our services, you represent and warrant that you meet these requirements.
3. Service Description
BorderProof is a technology and informational platform that provides visa pathway discovery, eligibility indicators, visa comparison tools, document readiness scoring, and immigration-related informational content. Our services are designed to help users explore and understand potential visa options based on the information they provide.
All outputs generated by BorderProof — including eligibility indicators, Readiness Scores, and pathway assessments — are informational tools only. They do not constitute determinations, decisions, recommendations, or advice of any kind. Users must not treat any output from BorderProof as a substitute for professional immigration advice or as a reliable indicator of likely government decision-making.
4. No Legal Advice
IMPORTANT:
- BorderProof is NOT an immigration law firm, is NOT licensed to practice law in any jurisdiction, and is NOT a government agency.
- We do NOT submit visa applications, represent users before any government body, or provide case-specific legal advice.
- Eligibility results and visa information provided through our platform do NOT guarantee visa approval or eligibility.
- Even if our tool indicates you may be "highly eligible," this does not mean you will be approved. Government decisions depend on many factors beyond what our platform assesses.
- You must always consult with qualified immigration attorneys and official government sources before making any immigration decisions.
BorderProof is NOT a registered migration agent under the Migration Agents Registration Authority (MARA) framework and does not provide migration agent services as defined under the Migration Act 1958 (Cth). No output from this platform constitutes migration advice for the purposes of that Act.
Nothing in these Terms limits, excludes, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where statutory guarantees apply and cannot be excluded, BorderProof's liability is limited to the maximum extent permitted by law, which may include (at BorderProof's election) resupply of the services or payment of the cost of resupply.
5. AI-Powered Features Disclaimer
Certain features of BorderProof, including eligibility indicators, Readiness Scores, and CV/resume data extraction, are powered by automated algorithms and third-party artificial intelligence services. These outputs are generated by machines, not human immigration experts, and are expressly provided as informational starting points only. AI-generated outputs may contain errors, inaccuracies, or outdated information and do not reflect the full complexity of individual immigration circumstances.
Where any output is flagged as "Adviser Confirmation Required," you must not act on that output without first obtaining verification from a qualified immigration professional. You are solely responsible for reviewing, verifying, and seeking professional advice on all platform outputs before taking any action, including submitting any visa application or making any immigration-related decision.
6. User Accounts
When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not share your credentials or allow others to access your account. Each person may maintain only one account. BorderProof reserves the right to suspend or terminate accounts that violate these terms or are used fraudulently.
7. User Data Accuracy
You are solely responsible for the accuracy of all information you provide to BorderProof, including but not limited to citizenship, criminal record history, visa refusal history, employment details, and educational qualifications. Inaccurate or incomplete input will produce inaccurate results. You must not provide false or misleading background information through our platform.
8. CV/Document Upload Terms
When you upload a CV or resume, the file is transmitted to a third-party AI service for processing and data extraction. By uploading a document, you consent to this processing and to the AI extraction of personal data contained within it. You may only upload documents that belong to you and that you have the right to share. Uploaded files are processed transiently and are not permanently stored on our servers.
9. Acceptable Use
You agree not to: scrape, crawl, or use automated means to access our platform without permission; reverse engineer, decompile, or attempt to extract the source code of our software; commercially redistribute our content, data, or eligibility results; or misrepresent eligibility results generated by our platform to governments, employers, or any other third parties.
10. Intellectual Property
All content, branding, designs, algorithms, and software on the BorderProof platform are the property of BorderProof or its licensors and are protected by applicable intellectual property laws. Your personal data remains your property. By using our services, you grant BorderProof a limited licence to use your data solely for the purpose of providing the service to you, as described in our Privacy Policy.
11. Data and Privacy
Your use of BorderProof is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal information. Please review the Privacy Policy carefully.
12. Third-Party Services
Our platform integrates with third-party services for authentication, data processing, analytics, and other purposes. BorderProof is not responsible for the availability, accuracy, or policies of these third-party services. Your use of such services may be subject to their own terms and conditions.
13. Disclaimer of Warranties
BorderProof is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we exclude all warranties, conditions, and representations of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure. We make no warranty as to the accuracy, completeness, or timeliness of any information or results provided, and no warranty that results will match actual government decisions on visa applications.
14. Limitation of Liability
To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded:
BorderProof and its officers, directors, employees, contractors, and agents expressly exclude all liability for any loss or damage, whether direct, indirect, incidental, special, consequential, exemplary, or punitive, including but not limited to: loss of opportunity; costs of failed visa applications; loss of employment or business opportunity; relocation costs; emotional distress; or any other economic or non-economic loss arising from or in connection with your use of or reliance on the platform or its outputs.
Without limiting the above, BorderProof is not liable for: immigration decisions made based on platform outputs; errors, inaccuracies, or omissions in AI-generated content; changes in visa requirements, government policies, or immigration law occurring after content was published; actions or omissions of any third-party immigration adviser, lawyer, or migration agent accessed through or in connection with the platform; or failures, interruptions, or unavailability of third-party services.
In any event, and notwithstanding any other provision of these Terms, BorderProof's total aggregate liability to you for all claims arising from or in connection with these Terms or your use of the platform shall not exceed the greater of: (a) the total fees paid by you to BorderProof in the twelve (12) calendar months immediately preceding the event giving rise to the claim; or (b) AU$100. For users who have not paid any fees, BorderProof's total liability is limited to AU$100.
The limitations in this clause apply regardless of the form of action, whether in contract, tort (including negligence), statute, or otherwise, and even if BorderProof has been advised of the possibility of such loss or damage.
15. Indemnification
You agree to indemnify, defend, and hold harmless BorderProof, its officers, directors, employees, contractors, and agents (each an "Indemnified Party") from and against any and all claims, liabilities, damages, losses, penalties, costs, and expenses (including reasonable legal fees on a solicitor-client basis) arising from or in connection with: (a) your use of or access to the platform; (b) your reliance on any eligibility indicator, Readiness Score, or other output provided by the platform; (c) your submission of false, inaccurate, or misleading information; (d) your violation of these Terms of Service; or (e) your violation of any applicable law or the rights of any third party.
16. Account Termination
BorderProof may suspend or terminate your account at any time if you violate these Terms of Service or for any other reason at our discretion, with or without notice. You may delete your account at any time. Upon termination or deletion, your right to use the service ceases immediately. Please refer to our Privacy Policy for details on data retention following account termination.
17. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. You agree that the courts of New South Wales shall have exclusive jurisdiction to resolve any dispute arising from or in connection with these terms.
18. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
19. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email to registered users and by updating the "Last updated" date on this page. Continued use of the service after changes constitutes acceptance of the updated terms.
21. Active Informed Consent
Prior to receiving any personalised output from the platform — including but not limited to eligibility indicators, Readiness Scores, pathway assessments, and document readiness reports — you will be required to actively confirm, by checking a designated tick-box or acknowledgement mechanism, that: (a) you understand the output is informational only and does not constitute legal, migration, or professional advice; (b) you will seek independent professional verification before relying on or acting on any output; and (c) you accept full responsibility for any decisions made based on the output. Failure to provide this confirmation will prevent access to personalised outputs.
22. Adviser Services
Where BorderProof facilitates access to third-party immigration advisers, lawyers, or registered migration agents ("Advisers") through its platform, the following terms apply:
- Advisers are independent professionals and are not employees, contractors, or agents of BorderProof. BorderProof does not supervise, direct, or control the professional services provided by Advisers.
- Any advice, review, certification, sign-off, or professional service provided by an Adviser is provided solely by that Adviser and is subject to the Adviser's own terms, professional obligations, and regulatory requirements.
- BorderProof makes no representation or warranty as to the qualifications, competence, suitability, or conduct of any Adviser.
- BorderProof is not liable for any act or omission of an Adviser, including any advice given, any error or omission in a review, or any failure to provide services to the required professional standard.
- Any engagement between you and an Adviser constitutes a direct relationship between you and that Adviser. BorderProof is not a party to that engagement.
