The E-2 Treaty Investor is a US nonimmigrant visa for nationals of treaty countries who invest a substantial, at-risk amount of capital in a US business they actively direct. No minimum dollar amount is fixed — the investment must be substantial relative to the business cost and the enterprise cannot be marginal.

Admission is up to 2 years per entry, extendable in 2-year increments with no overall cap while the enterprise qualifies. The $315 MRV fee applies, plus reciprocity fees by nationality. Spouses get automatic work authorization; children under 21 may accompany. There is no annual cap, but no direct path to permanent residence and no dual intent.

This visa is ideal for entrepreneurs from one of the ~80 treaty-eligible countries who want to launch or acquire a US business and live there while running it.
