Overview

Two-year renewable residence permit historically granted to rejected asylum seekers who cannot be returned, providing employment access and core welfare benefits.

Specific Residence Authorisation was created for individuals who were rejected for asylum but cannot be returned to their country of origin. It requires proof of long-term physical presence and active integration into Maltese society. Note that this program is currently closed to new applicants and is only available for renewals.

Requirements

ELIGIBILITY REQUIREMENTS

Must have entered Malta in an irregular manner prior to 1 January 2016.

Must have been physically present in Malta for at least 5 years preceding the application date.

Must have stable employment (minimum 9 months per year).

Must demonstrate good conduct (no serious criminal convictions, including suspended sentences of 12+ months).

Must provide evidence of integration efforts (e.g., integration certificate from the Human Rights Directorate or assessment report).

Must have a stable relationship (if applicable) or meet specific family unity criteria for those who entered Malta irregularly before 31 December 2015.

Valid identification/travel document.

Evidence of irregular entry prior to 1 January 2016.

Proof of stable employment for at least 9 months per year.

Integration certificate or Human Rights Directorate assessment report.

Proof of residence in Malta.

Completed Form H and GDPR form.

Book an appointment with Identità's Expatriates Unit.

Complete the required forms (Form H, GDPR form, etc.).

Submit the application in person at the Identità Hal-Far office.

Undergo assessment by the Expatriates Unit, which may include a referral to the Police Immigration Section.

Attend an interview if requested by the agency.
