Residence document for non-EU family members of EEA or Swiss citizens exercising their right of free movement in Hungary, valid up to 5 years.
The Residence Card for Third-Country Family Members of EEA Nationals is rooted in the fundamental European Union principle of the freedom of movement, specifically codified through Directive 2004/38/EC. This directive mandates that citizens of the European Economic Area (EEA) and Switzerland have the right to reside in any member state, and that their family members—regardless of their own nationality—must be granted the right to accompany or join them to ensure the cohesion of the family unit. In Hungary, this framework is integrated into the national immigration system to fulfill the country’s obligations under EU law, effectively bridging the gap between standard, restrictive third-country national visa pathways and the more fluid mobility rights enjoyed by EU citizens. By establishing this specific residence card, the Hungarian government provides a streamlined legal mechanism that bypasses the stringent labor market tests and quota systems typically applied to non-EU migrants, ensuring that the right to family life does not become a bureaucratic barrier to the exercise of free movement.
This visa is designed for non-EEA nationals who are spouses, children, or dependent relatives of an EEA or Swiss citizen who has established residency in Hungary. The ideal applicant is a family member seeking to settle alongside an EU national who is currently working, studying, or otherwise exercising their treaty rights within the country. Unlike standard work or business visas, which are often contingent upon specific employment contracts or investment thresholds, this residence card is distinctive because it is inherently linked to the status of the EEA sponsor rather than the applicant’s professional qualifications or economic output. It offers significant advantages, including a validity period of up to five years, the right to work without needing a separate work permit, and a simplified application process that is entirely free of charge. While the visa provides a robust pathway to long-term integration, it remains strictly conditional; the applicant’s legal status is tethered to the sponsor’s continued compliance with residency requirements, meaning that should the family relationship dissolve or the EEA national depart Hungary, the cardholder must transition to a different immigration category to maintain their legal standing.
Applicant must be a third-country national family member of an EEA or Swiss national.
The EEA/Swiss national must be residing in Hungary for more than 90 days.
The EEA/Swiss national must be engaged in gainful activity (employed, self-employed) or have sufficient financial resources and health insurance to not be a burden on the Hungarian social security system.
Family members include spouses, descendants under 21 or dependents, and dependent ancestors.
