Overview

Renewable 1-year residence permit for individuals in exceptional humanitarian circumstances under Article 9, requiring demonstrated integration.

The Humanitarian Visa (Articles 9 & 13) is Belgium's discretionary route for individuals in exceptional circumstances—medical emergencies, extreme hardship, or urgent humanitarian need—who cannot qualify through standard immigration channels. The Belgian Immigration Office assesses applications on a case-by-case basis.

The visa is renewable and valid for up to one year initially. Fees are EUR 180 (visa application) plus a humanitarian contribution; note that from 1 July 2026, an additional EUR 250 fee increase takes effect. Processing takes 30 to 180 days.

This visa is ideal for individuals facing urgent humanitarian crises—medical emergencies, family emergencies, or severe hardship—who lack standard immigration pathways and seek Belgian protection or long-term stability.

Advantages & Considerations

Key Benefits

  • Renewable annually with path to permanent residency despite humanitarian pathway
  • Up to 365 days initial authorization renewable annually on demonstrated integration
  • No job offer required; humanitarian reasons take priority over standard criteria
  • Dual intent allowed; can pursue permanent settlement while demonstrating integration
  • Lower total cost than standard work visas (EUR 422 until 30 June 2026)
  • Case-by-case assessment provides flexibility for truly exceptional hardship situations
  • Work authorization possible dependent on individual circumstances and approved status

Worth Knowing

  • Requires detailed proof of exceptional circumstances and financial means for support
  • Annual renewal hinges on demonstrating integration, studies, work, and public-order compliance
  • Processing timeline highly variable (30-180 days) due to case-by-case discretionary nature
  • Visa fee increases to EUR 250 on 1 July 2026; total cost becomes EUR 492 thereafter
  • Highly discretionary — failure to prove exceptional circumstances results in automatic denial
  • Security concerns or criminal record can disqualify applicants regardless of humanitarian merit
