Partner (Provisional) Visa — Onshore.

The Subclass 820 is an onshore partner visa for the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen. Applicants must be in Australia at lodgment and show a genuine relationship — de facto couples need at least 12 months of cohabitation.

The 820 grants full work rights, Medicare access, and travel while awaiting a decision. After approximately 2 years, the permanent Subclass 801 stage is assessed automatically, granting permanent residency if the relationship remains ongoing. The combined government fee is AUD $9,365.

ELIGIBILITY REQUIREMENTS

Must be the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.

Must be in Australia at the time of application.

Relationship must be genuine and continuing, with a mutual commitment to a shared life to the exclusion of all others.

Must live together or not live separately and apart on a permanent basis.

De facto partners must have been in the relationship for at least 12 months, or have registered the relationship under state/territory law.

Must meet health and character requirements.

Must have no outstanding debts to the Australian Government.

Must not have had a visa refused or cancelled since last entering Australia (if not holding a substantive visa).
